Website Terms of Service

These Terms of Service (“Terms”) govern your access to and use of houseping.ca and the referral services offered by BOUCHARD INVESTMENT CORP., operating as HousePing (“HousePing,” “we,” “us,” or “our”).
By using the website or submitting a service inquiry, you agree to these Terms. If you do not agree, do not use the website or referral service.
1. HousePing’s Role
HousePing operates a referral service that connects customers with independent home-service providers.
HousePing does not itself provide handyman, painting, lawn-care, landscaping, renovation, construction or other referred services. HousePing is not a contractor, subcontractor, employer, partner, joint venturer or agent of any referred service provider.
Service providers are independent businesses. They control how their services are quoted, scheduled, performed and billed.
2. Referral Requests
When submitting an inquiry, you agree to provide accurate and reasonably complete information about:
Your identity and contact information.
The property or location requiring service.
The requested work.
Relevant access, safety or project conditions.
Your preferred timing and other material requirements.
Submitting an inquiry does not guarantee that a suitable provider will be available or willing to accept the project.
HousePing may share the information you provide with one or more independent service providers for the purpose of responding to your inquiry.
3. Independent Service Providers
Any provider introduced through HousePing is solely responsible for:
Assessing the requested work.
Providing estimates, quotations and contracts.
Determining pricing, deposits and payment terms.
Obtaining required licences, registrations, permits and inspections.
Maintaining appropriate insurance and workplace-safety coverage.
Supplying labour, supervision, materials, tools and equipment.
Performing services safely, professionally and according to applicable law.
Providing warranties, corrections, refunds or other remedies relating to its work.
HousePing does not direct, control or supervise a provider’s work.
4. Your Contract Is With the Provider
Any estimate, work order, service agreement, renovation contract, warranty, invoice or payment arrangement is exclusively between you and the independent service provider.
HousePing is not a party to that agreement and does not collect or process payment for the provider through the HousePing website.
You should obtain a written contract directly from the provider before work begins. The contract should clearly address the scope of work, price, taxes, payment schedule, expected completion date, permits, warranties, cleanup, insurance and procedures for changes.
5. Evaluating Providers
HousePing may use reasonable efforts to identify providers that appear capable of responding to a request. However, HousePing does not guarantee or warrant:
A provider’s identity, qualifications, licensing, insurance or legal compliance.
The accuracy of information supplied by a provider.
The quality, safety, legality, timeliness or suitability of a provider’s work.
The accuracy or completeness of an estimate.
That a provider will accept or complete a project.
That a provider will meet your expectations.
The outcome of any dispute with a provider.
Before hiring a provider, you are responsible for conducting your own assessment. This may include checking references, licences, insurance, workplace-safety coverage, reviews, written estimates and contractual terms.
6. Changes, Problems and Disputes
Questions, deficiencies, delays, property damage, injuries, warranties, billing concerns, cancellations and disputes arising from a provider’s services must be addressed directly with that provider.
HousePing may choose to facilitate communication but is not obligated to mediate, adjudicate, reimburse or resolve disputes.
Nothing in these Terms limits any rights or remedies you may have against a provider under applicable consumer-protection or other laws.
7. No Emergency Services
HousePing is not an emergency-response service. Do not use the website for emergencies, imminent hazards, gas leaks, active flooding, fires, electrical dangers, medical emergencies or other urgent threats.
Contact the appropriate emergency service, utility or qualified emergency professional.
8. Communications
By submitting an inquiry, you authorize HousePing to contact you by telephone, email or SMS concerning that inquiry and to share your contact information with relevant independent service providers.
Service-related communications are separate from promotional communications.
HousePing will send promotional email or SMS messages only where it has the consent or other lawful authority required. You may withdraw marketing consent using the unsubscribe instructions in the message or by contacting [email protected].
9. Acceptable Use
You must not:
Submit false, fraudulent, misleading or unlawful requests.
Impersonate another person.
Use the website to harass, threaten or harm others.
Interfere with the website’s security or operation.
Attempt unauthorized access to systems or information.
Introduce malware, automated scraping tools or harmful code.
Copy or commercially exploit website content without permission.
Use the service for an unlawful or prohibited purpose.
We may restrict or terminate access where we reasonably believe these Terms have been violated.
10. Website Information
Website content is provided for general information. Although we try to keep information accurate, it may contain errors or become outdated.
Descriptions of services, service areas and provider availability are not binding offers or guarantees. HousePing may change or discontinue any part of the website or referral service without notice.
11. Intellectual Property
The HousePing name, branding, website design, written content, graphics and other materials owned by HousePing are protected by applicable intellectual-property laws.
You may use the website for personal, non-commercial purposes related to finding home services. No ownership rights are transferred to you.
Third-party names and materials remain the property of their respective owners.
12. Third-Party Services and Links
The website may contain links to third-party websites, maps, tools, platforms or service providers. HousePing does not control and is not responsible for third-party content, availability, security, terms or privacy practices.
Your dealings with third parties are governed by your agreements with them.
13. Disclaimer
To the fullest extent permitted by law, the website and HousePing referral service are provided on an “as is” and “as available” basis.
HousePing disclaims all representations, warranties and conditions not expressly stated in these Terms, including implied warranties or conditions of merchantability, fitness for a particular purpose, quality, non-infringement, availability and error-free operation.
HousePing does not warrant the services or conduct of independent service providers.
Some jurisdictions do not permit certain exclusions. In those cases, the exclusions apply only to the maximum extent permitted by law.
14. Limitation of Liability
To the fullest extent permitted by law, HousePing and its directors, officers, employees and representatives will not be liable for:
Acts, omissions, negligence or misconduct of an independent service provider.
Defective, incomplete, unsafe, delayed or unsatisfactory work.
Property damage, personal injury, financial loss or other harm caused by a provider.
Disputes concerning quotes, contracts, deposits, payments, warranties or refunds.
Indirect, incidental, special, consequential, exemplary or punitive damages.
Loss of profits, revenue, opportunity, data, goodwill or anticipated savings.
Website interruptions, errors, malicious code or unauthorized access beyond our reasonable control.
Where liability cannot lawfully be excluded, HousePing’s aggregate liability arising from the website or referral service will be limited to the greater of the amount you paid directly to HousePing for the applicable referral service or CAD $100.
This section does not exclude liability that cannot legally be excluded or limit rights available under applicable consumer-protection legislation.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold HousePing harmless from claims, liabilities, damages, costs and reasonable legal fees arising from:
Your unlawful or improper use of the website.
Information or materials you submit.
Your violation of these Terms.
Your infringement of another person’s rights.
This provision does not require you to indemnify HousePing for HousePing’s own unlawful conduct or liability that cannot legally be excluded.
16. Privacy
Our collection and handling of personal information are described in the HousePing Privacy Policy, available on our website.
17. Governing Law
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada.
Subject to any rights you have under applicable consumer-protection law, disputes involving HousePing will be submitted to the courts of Ontario.
18. Changes to These Terms
We may update these Terms periodically. Revised Terms will be posted with an updated effective date.
Changes apply prospectively from the date they are posted. Your continued use of the website after that date constitutes acceptance of the revised Terms.
19. General Provisions
If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.
A failure to enforce a provision is not a waiver.
These Terms and the Privacy Policy constitute the agreement between you and HousePing concerning your use of the website and referral service. They do not replace any separate agreement between you and an independent provider.
